When we ask you for personal information online, it will only be in response to you using one of our online products or services, such as BEC Pay mobile application. We may use the personal information you provide for the purpose of providing more relevant content to you.

By submitting your personal details to us, you are deemed as agreeing to us using them in line and in accordance with the terms and conditions in this policy. If you fail to provide personal data
Where we need to collect personal data by law, or under the terms of a contract we have with you, and you fail to provide that data when requested, we may not be able to perform the contract we have or are trying to enter into with you (for example, to provide you with services). In this case, we may have to cancel a service you have with us, but we will notify you if this is the case at the time.

We engage, retain or might, as per requirement and business needs of the Company, employ, engage, contract with third party service professionals/providers to work on behalf of or with Us, under agreements containing confidentiality obligations and in accordance with law, in relation to the services provided by Us on the Platform. These third-party service providers may use Your personal information in assisting Us to communicate with You about Our offers, feedback of Services, assisting in payment facilities, providing customer support, assisting in advertising on the Platform etc. We may employ third party companies and/or individuals to help improve or facilitate our service, to provide the Service on our behalf, to perform platform-related services, including but not limited to: payment processing, maintenance services, fraud detection services, database management, web analytics, monitoring, delivery/logistics and evaluation services. In this event, your information may be shared with such third-party companies and/or individuals;

Direct interactions: You may give us your Identity, Contact, Profile, Sensitive Personal Data, Financial, and Transaction Data by filling in forms, using our mobile app, using our website, or by corresponding with us by post, phone, email, or otherwise. This includes personal data you provide when you:

Automated technologies or interactions: As you interact with our mobile app & website, we will automatically collect Technical Data about your equipment, browsing actions, and patterns. Third parties or publicly available sources: We will receive personal data about you from various third parties and public sources as set out below:
- Identity, Contact, Profile, Financial, and Sensitive Personal Data from corporations we work with to provide remittance services in the mobile app.
- Identity, Contact, Profile, Financial, Transactional, and Sensitive Personal Data from branches of BEC in order to comply with KYC and regulatory checks.
- Identity and Contact Data received from Central Bank of Kuwait or other Authorities to follow-up on complaints raised by customers.
- Identity, Contact, and Profile Data from recruitment agencies referring potential candidates.
How we use your personal data
We will only use your personal data when the law allows us to. Most commonly, we will use your personal data in the following circumstances:
- Where we need to perform the contract, we are about to enter into or have entered into with you.
- Where it is necessary for our legitimate interests (or those of a third party) and your interests and fundamental rights do not override those interests.
- Where we need to comply with a legal obligation.
Generally, we do not rely on consent as a legal basis for processing your personal data, although we will get your consent before sending direct marketing communications to you. You have the right to withdraw consent to marketing at any time by contacting us.

We require all third parties to respect the security of your personal data and to treat it in accordance with the law. We do not allow our third-party service providers to use your personal data for their own purposes and only permit them to process your personal data for specified purposes and in accordance with our instructions.
International Transfers
Many of our external third parties are based outside the EEA and/or Kuwait so their processing of your personal data will involve a transfer of data outside the EEA and/or Kuwait.
Whenever we transfer your personal data out of the EEA and/or Kuwait, we ensure a similar degree of protection is afforded to it by ensuring at least one of the following safeguards is implemented:

How we protect your personal data
We treat the security of all data held by BEC Pay with the utmost importance, and that includes your personal data.
We have put in place appropriate security measures to prevent your personal data from being accidentally lost, used, or accessed in an unauthorized way, altered or disclosed. In addition, we limit access to your personal data to those employees, agents, contractors and other third parties who have a business need to know. They will only process your personal data on our instructions, and they are subject to a duty of confidentiality.
We have put in place procedures to deal with any suspected personal data breach and will notify you and any applicable regulator of a breach where we are legally required to do so.
How long we retain your personal data.
We will only retain your personal data for as long as reasonably necessary to fulfil the purposes for which we collected it, including for the purposes of satisfying any legal, regulatory, tax, accounting, or reporting requirements. We may retain your personal data for a longer period in the event of a complaint or if we reasonably believe there is a prospect of litigation with respect to our relationship with you.
To determine the appropriate retention period for personal data, we consider the amount, nature and sensitivity of the personal data, the potential risk of harm from unauthorized use or disclosure of your personal data, the purposes for which we process your personal data and whether we can achieve those purposes through other means, and the applicable legal, regulatory, tax, accounting or other requirements.

No fee is usually required
You will not have to pay a fee to access your personal data or to exercise any of the other rights. However, we may charge a reasonable fee if your request is clearly unfounded, repetitive, or excessive. Alternatively, we could refuse to comply with your request in these circumstances.
What we may need from you
We may need to request specific information from you to help us confirm your identity and ensure your right to access your personal data or to exercise any of your other rights. This is a security measure to ensure that personal data is not disclosed to any person who has no right to receive it. We may also contact you to ask you for further information in relation to your request to speed up our response.
Time limit to respond
We try to respond to all legitimate requests within 15 calendar days. Occasionally it could take us longer than a month if your request is particularly complex or you have made several requests. In this case, we will notify you and keep you updated.

Further to the rights that we comply with above, you also have the right to submit a formal written complaint to the relevant Data Protection Authority if you have reason to believe that we have not complied with the data protection laws.

We may collect statistical data about our users’ browsing/ app usage actions and patterns which do not identify the individual.

Glossary
Our lawful bases
Data protection laws applicable to BEC Pay set out a number of requirements for legitimate processing of your personal data, these are often known as lawful bases for processing. These lawful bases are:
- Contractual obligation – processing of personal data in order to implement a contract to which you are a party or, upon your request, to conclude a contract.
- Legal requirement – processing of personal data to implement an obligation prescribed by the Law or implementation of a court order from a competent Court or the Public Prosecution.
- Protection of your vital interests – processing of personal data to save your life.
- Legitimate interests – processing personal data where we have a legitimate interest to do so to run our business. We may use this basis where it does not conflict with your rights and freedoms set out in ‘Your legal rights’ below.
- Consent – processing personal data where you have given us written, explicit, and clear consent to processing for a specific purpose issued based on your free will or based on the free will of your guardian, executor, or custodian.
Your legal rights
Under the data protection laws applicable to BEC Pay, you have the right to:
Right to be informed If we collect and use your personal data or if this is done by a third party, on our behalf. We do this by letting you know this within this Privacy Notice.
Right to be notified of processing of your personal data, especially as to whether we are processing your personal data or if this is done by a third party, on our behalf.
Request access to your personal data (commonly known as a “data subject access request”). This enables you to receive a copy of the personal data we hold about you and to check that we are lawfully processing it.
Request correction of the personal data that we hold about you. This enables you to have any incomplete or inaccurate data we hold about you corrected, though we may need to verify the accuracy of the new data you provide to us.
Request erasure of your personal data. This enables you to ask us to delete or remove personal data where there is no good reason for us continuing to process it. You also have the right to ask us to delete or remove your personal data where you have successfully exercised your right to object to processing (see below), where we may have processed your information unlawfully or where we are required to erase your personal data to comply with local law. - Where our use of the data is unlawful but you do not want us to erase it.
- Where you need us to hold the data even if we no longer require it as you need it to establish, exercise or defend legal claims.
- You have objected to our use of your data but we need to verify whether we have overriding legitimate grounds to use it.
Request the transfer of your personal data to you or to a third party. We will provide to you, or a third party you have chosen, your personal data in a structured, commonly used, machine-readable format. Note that this right only applies to automated information which you initially provided consent for us to use or where we used the information to perform a contract with you.
Withdraw consent at any time where we are relying on consent to process your personal data. However, this will not affect the lawfulness of any processing carried out before you withdraw your consent. If you withdraw your consent, we may not be able to provide certain products or services to you. We will advise you if this is the case at the time you withdraw your consent.
Terms & Conditions - User Agreement
This Agreement is a contract between You and Bahrain Exchange Co. WLL which is the operator of BEC Pay mobile application. By using the BEC Pay mobile application means that you have accepted all the terms and conditions contained in this Agreement.
1. General Terms and Condition
- These terms and conditions (“T&C” or “Terms”) govern the terms under which you may access and use the products of Bahrain Exchange Co. WLL, which include the BEC Pay App, BEC Pay Website (as applicable) and the services associated with it (together the “Service” or “Services”). By accessing, registering, or using the Service, you agree to be bound by the terms of this T&C.
- Under these T&C, the terms “BECP”, “we”, “us”, and “our” refer to Bahrain Exchange Co. WLL, incorporated in the State of Kuwait under commercial registration number CR 46619 and having its registered address at Abdulaziz Hamad Al Saqr street, Al Hajri Building, Block No.1 , Plot No. 1A, Murgab, Kuwait City, PO BOX 29149, Safat-13152, State of Kuwait (Opposite Liberation Tower), Murgab – Kuwait City
- The terms “User”, “you” and “““your” refer to users of the Service, as Account Holders, Senders, Recipients, and other applicable users of the Service.
- These T&C shall be effective, valid and binding from the time that you agree to it or the time you use any of the Services and will be in full force and effect up to the time that it is terminated by you or us, save for some provisions which shall remain effective after termination, as stated in this T&C, under any applicable law, rule or regulation.
2. Definitions Of Terms
- BEC Pay: Means the Bahrain Exchange Co WLL Mobile Application installed on the User’s smartphone, which is a mobile payment software that facilitates cross-border transactions.
- Call Centre” refers to the customer care telephone helpline and email provided by BECP for the App.
- “Dispute” means any contentious matter reported by a User to BECP related to a financial transaction on the App.
- “Merchant” means the entity/person that receives the payment through the App in exchange for rendering assets/ services to a User.
- “Payment Instrument” means the tool used for making payments on the App, issued by BECP or by a User’s Bank i.e., debit card or bank account.
- “Transaction” means the process carried out between a User and a Merchant to exchange an asset or service for payment or a fund transfer between a payer and a beneficiary through the App.
- “User” means any person who uses the Bahrain Exchange Co. WLL Mobile Application
3. BEC Pay Services
1. BEC Pay Account
- BEC Pay Account is a profile at Bahrain Exchange Co. WLL to do remittance via the BEC Pay mobile application.
- It shall be treated as a personal account of the Account Holder and shall not be used to engage in the business of remittance or for any other business purposes, except upon execution of a written agreement with BEC Pay allowing such. It is subject to the rules and regulations of the CBK and the Anti-Money Laundering Law No.106 of 2013) and the Data Privacy Act; wherein penalties and consequences arising from violations to the rules and regulations of CBK, and other governing bodies made by the Account Holder shall be under the liability of the Account Holder.
2. Eligibility
- User must be a resident of Kuwait having a valid Civil ID and must have attained 18 years of age for availing the services. Any person shall be required upfront to download & register with BECP on their mobile smart phone. The App will link with the profile provided /confirmed by the User at the time of registration and will be associated with the registered mobile number of the User.
- You are eligible to hold only one account with BEC Pay at any given time.
4. BEC Pay Account Terms
- BEC Pay is constantly innovating in order to provide the best possible experience for its users. You acknowledge and agree that BEC Pay may make new services available to You. We will notify You of any amendments to the Agreement resulting from the introduction of new services by email or by providing a link to the updated Agreement at least thirty (30) days prior to the new service becoming available.
- You acknowledge and agree that BEC Pay may stop providing the Account Services to You as provided in the Agreement. You may stop using the Services at any time. You do not need to inform BEC Pay when You stop using the Services.
- You acknowledge and agree that BEC Pay may establish general practices and limits concerning the use of the Services without prior notice to You, including without limitation individual or aggregate transaction limits on the value or number of transactions during any specified time period(s). In addition to any applicable account limits, We may restrict transactions to or from Your Account or limit access to Your Account or in such amounts and for such time as we reasonably deem necessary to protect Us or other users if (a) We are subject to financial risk, (b) You have violated any term of this Agreement, (c) any dispute exists involving Your Account or transaction conducted in connection therewith, or (d) needed to protect the security of Our systems.
- We may restrict access to Your Account while We complete any pending investigation or resolve a pending dispute. We also may hold the funds in Your Account as required by law or court order or if otherwise requested by law enforcement or any governmental entity.
- BEC Pay may refuse to execute any transactions or orders or other use of the services if BEC Pay has reasonable grounds to suspect fraud, a breach of the applicable Agreement by You or a violation of law.
- Transactions may also be delayed due to BEC Pay’s or a third party’s compliance with its obligations under applicable anti-money laundering legislation, including if BEC Pay or the relevant third party suspects the transaction involves fraud or any other financial crime. In the event that BEC Pay refuses to execute a transaction or order or other use of the services, you will be notified, and We will provide You with objectively justifiable reasons for the refusal, unless it is unlawful for BEC Pay to do so or would compromise reasonable security measures. Funding, payments, and transfers are displayed in Your Account, and You should check Your Account balance and transaction history regularly. You should report any irregularities or clarify any questions You have as soon as possible. We will provide You with a history of the transactions that You make under this Agreement at least once per month free of charge, including details of the amounts, the fees, charges and commissions, the dates and times of execution and the reference numbers for each transaction.
5. Identity Verification
- You agree to present BEC Pay Your valid Civil ID, Your ID number, and Expiry Date when requested. You authorize BEC Pay, directly or through third parties or third-party technology solutions, to make any inquiries/process to validate your identity. This may include asking you for further information or documentation, like a photo of your face, recorded video of your face or additional documents to verify your identity.
- You agree that we contact PACI (Public Authority of Civil information) to verify and collect your record for opening the account and completing our KYC process via the Kuwait Mobile ID platform.
- You Agree our authorized person can contact / visit you to complete the verification process of your identity through direct interaction.
- You agree to do the compliance Checking process prior to approval and acceptance of the account creation.
6. International Remittance
You may transfer funds from bank account through Your account to International Remittances. You hereby acknowledge and agree that this Account is powered and serviced by Remittance Intermediaries and such International Remittances will be subject to special terms and conditions. Refer to BEC’s Digital Remittance service Terms and Conditions for more information.
7. Other Service Providers
BEC Pay may introduce other payment transactions from time to time and will update these provisions accordingly.
8. Statement
You acknowledge and agree that not receiving the account statement does not excuse You of Your obligation to make payment of the amounts due on Your Payment Cards to Us. In the event you disagree with any amount charged to Your Payment Card account as indicated in the statement, You must communicate the same to Us by reaching out to our customer support service within 7 days of showing such transaction on the statement, failing which, We will not be responsible if the transaction concerning such issue is not successfully disputed with the transaction processing bank or the biller.
9. Other service terms
- User authorizes BECP to store certain data of the payment instruments and transaction history and information.
- The User shall not hold BECP responsible for any Dispute arising from any purchase of goods/services from any Merchant through Transactions initiated through the App or fund transfers to any beneficiary. The User understands and agrees that all such claims, if any, shall be against such Merchant(s) or beneficiary(ies) and not against BECP.
- BECP does not warrant that the use of the App or its content will be uninterrupted or error- free and expressly disclaims all representations and warranties, whether express, implied, or statutory to the extent permitted by applicable laws including any warranty of fitness for a particular purpose or merchant ability.
10. BEC Pay App Rewards program
1. Definitions
- “BEC Points” is the term used to represent the rewards from the BEC Pay rewards program.
- “Merchant” is a term used to represent the brands/shops for which a Gift Card or Voucher is issued.
- “Vouchers” is a term used to refer discount coupons that can be used at a merchant, either online or offline, depending on the voucher type. This will be sent to the user via email with detailed instructions on how to use the voucher.
- “Gift Card” is a term used to refer to the redeemable value mentioned in the gift card against the merchant mentioned in the gift card. It will be sent to the user via email with detailed instructions on redeeming from the merchant.
2. Eligibility:
- Only fully registered (Kyce’d) BEC Pay App users will be eligible for this program.
- All requested actions to be completed by users on the BEC Pay App will be displayed on the rewards homepage to get the reward.
- Certain reward programs (campaigns) may be exclusive to a specific user base as indicated in the BEC Pay App, and only those users will be eligible for those programs (campaigns) & rewards.
3. Rewards:
- BEC Pay App will reward the user against a requested action by a reward program. Eg: completing a successful remittance with a value of XX KWD and getting rewarded with XXX “BEC Points”.
- The user can earn various rewards from BEC Pay like “BEC Points”, Cashbacks, Vouchers, and Gift Cards
- The reward is completely randomized using various algorithms to ensure fairness with all users of that campaign.
4. BEC Points:
- These points hold a corresponding monetary value in BHD which will be mentioned in the BEC Pay App.
- These points can be redeemed in the marketplace in the app, redeemed for ‘Vouchers’ or ‘Gift Card’ from listed merchants in the marketplace.
- Redeemed Gift Cards will be sent as an email with detailed instructions on the redemption process with the relevant merchant.
5. Validity:
- BEC Points earned during the year will be valid for redemption until the end of the same year. Unused points will expire on 31st December of the same year.
- Gift Cards & Vouchers will be issued with an expiration date, which will be mentioned in the email along with the detailed instructions.
6. Redemption:
- BEC Points can be redeemed through the Marketplace, which consists of gift cards or discount voucher from brands in Kuwait.
- Redemption options may vary occasionally, and the current options available will be visible within the BEC Pay App.
7. Non-Transferability:
- BEC Points earned under this program are non-transferable and cannot be gifted, sold, or assigned to anyone else.
8. Modifications:
- We reserve the right to modify, amend, or terminate the Reward Program, in whole or in part, at any time and for any reason without prior notice, and users shall be notified by such means as deemed fair.
9. Termination:
- We reserve the right to terminate any user’s participation in the program at any time and for any reason, including but not limited to violating these terms and conditions or our policies/procedures.
10. Support Channel:
- For any support related to the rewards, the user can contact BEC Payments customer support via In-App chat, WhatsApp, Call, etc.
11. Liability:
- We shall not be liable for any loss or damage resulting from the user’s participation in the program, including any errors or omissions in calculating or awarding BEC points.
12. General:
- The user undertakes and agrees to indemnify BEC Pay against any loss, damages, liability, costs, and expenses, whether legal or otherwise, which BEC Pay may incur because of these Terms and Conditions or by any breach thereof by the user or the enforcement of BEC Pay’s rights as herein provided.
- Each of the provisions hereof shall be severable and distinct from one another. If at any time any one or more of such provisions is or becomes invalid, illegal, or unenforceable, the validity, legality, or enforceability of the remaining provisions shall not in any way be affected thereby.
- No forbearance, delay, or indulgence by BEC Pay in enforcing these Terms and Conditions shall prejudice or restrict the rights of BEC Pay, nor shall any waiver of its rights operate as a waiver of any subsequent breach.
- These Terms and Conditions have been prepared in English in case of any contradiction between the English and any translated texts of these Terms and Conditions, the English text shall prevail.
13. Governing Law:
- These terms and conditions shall be governed by and construed in accordance with the laws of the State of Kuwait and subject to the exclusive jurisdiction of the courts of the State of Kuwait.
11. Service Charges
Charges for services provided on the App shall be informed upfront to the User. BECP reserves the right to change or modify charges by giving prior notice and recover from the User such charge for providing services through the App. The User hereby authorizes BECP to recover the said charges by debiting the account.

13. PERSONAL INFORMATION
- BECP may collect and/or store the User’s personal data only to the extent and for the purpose(s) required and permitted under applicable laws and subject always to the prior written consent of the User which can be revoked by the User at any time. BECP will not share any personal or sensitive data with any third-party without the prior written consent of the User which can be revoked by the User at any time, unless required for legal purposes.
- You authorize BECP to show the account registered in the App to the paying party when the paying party uses the beneficiary mobile number/National ID (CIVIL ID) to transfer.
- You authorize and give consent to BECP to use the information for the purpose of market analysis, marketing and for statistical purposes.
- The Account Holder shall immediately notify BEC Pay via telephone, BEC Pay app or a written notice of any change in his/her Identify documents, or address and/or contact details/telephone number(s), which shall be subject to verification by BEC Pay through presentation of proper documents. The request shall be considered valid and final upon authentication of User, based on BEC Pay verification process. Verification process may be through mobile app or via email, or through call or face to face verification.
- As applicable, Account Holder may also change their personal information via the App, following the instructions and security measures set by BEC Pay. The request shall be considered valid and final upon authentication of User, based on BEC Pay verification process.
14. Your Obligations
- You agree to abide by the obligations stated under this section. You understand that failure to abide by these obligations is subject to BEC Pay applying suspension and/or termination of your BEC Pay Account, and proper reporting to the applicable authority of the laws, rules and regulations that govern BEC Pay
- You will pay all obligations, Service fees and Tax that may be imposed depending on the Service that you availed. BEC Pay has the right to deduct from your BEC Pay account any and all monies that may be due and demandable by BEC Pay.
- Your primary email address and mobile phone number will be up to date so that BEC Pay can communicate with You electronically.
- You agree not to alter, modify, or cause the alteration or modification, of the Services, without prior written consent from BEC Pay. You further agree not to use the Services for any commercial use, without prior written authority from BEC Pay.

- You agree not to gain or attempt to gain unauthorized access to any part or feature of the Services or to any other system or network connected to the Services. You also agree not to gather, harvest, or otherwise collect information about others using the Services without their explicit informed consent; nor restrict, prevent or prohibit any other party from using the Services, including but not limited to such actions which may tend to discourage others from using the Services, such as stalking, flaming or the lashing out at other parties, spamming or the sending of unsolicited information, advertisement or content, flooding or the sending of repetitive message, trolling or the use of insulting or deliberately divisive information, material or content, other forms of annoyances, and the like.
- You agree not to circumvent, disable, or otherwise interfere with security-related features of the Services, including those that prevent or restrict use or copying of any content, material, or information available on or through the Services, as well as those that enforce limitations on the use of the Services.
- You agree not to probe, scan, or test the vulnerability of the Services or any network connected to it, and not to breach the security or authentication measures on the same. You agree not to reverse look-up, trace or seek to trace any information on any user of or visitor to the Services, or any other customer of BEC Pay including any account maintained with the Services not owned by you, to its source, or exploit the Services or any information made available or offered by or through the Services, in any way where the purpose is to reveal any information, including but not limited to personal identification, other than your own information.
- You agree to use or access the Services for your information and personal use solely as intended through the provided functionality of the Services. You agree not to copy or download any material or content from or through the Services unless such copying or downloading is explicitly allowed by a visible manifestation thereof such as a “download” button or a similar link ostensibly displayed. You further agree not to engage or attempt to engage in the use, copying, transmission, broadcast, display, distribution or sale of any of the contents, material or information available on or through the Services, including user comments and the like, other than as expressly permitted herein, or as explicitly indicated in the Services, including use thereof for commercial purposes.
- You agree that you will not take any action that imposes an unreasonable or disproportionately large load on the infrastructure of the Services or its systems or networks, or any systems or networks connected to the Services.
- You agree not to incorporate any word in your name, message identification, or custom user title that is defamatory, obscene, or profane, or which violates any trademark, service mark, or other intellectual property rights of any third party, including that of BEC Pay. You likewise agree not to use any trademark, trade name, service mark, or logo in a way that is likely or intended to cause confusion about the owner or authorized user of such marks, names, or logo.
- You agree not to use any device or routine to interfere or attempt to interfere with the proper working of the Services or any transaction being conducted using the Services, or with any other person’s use of the Services. You agree that you will not engage in any activity that interferes with or disrupts the Services or the servers and networks which are connected to the Services.
- You undertake to provide us with: (a) true, accurate, current and complete evidence of your identity, and promptly update your personal information if and when it changes; (b) provide us with any identity documentations as may be requested by us; (c) provide us with details of one or more Payment Instruments; (d) provide us with true, accurate, current and complete information is required to receive the Service and any other information which may be required in relation to the Recipient; and (e) any other information that must be provided for the Service to be properly executed, as specified when you enter the details of the Service you are interested. You agree not to conceal your true name or use fictitious name, otherwise, BEC Pay may take appropriate action against you through Law.
- Once You confirm the Transaction or ask BEC Pay to proceed with the Transaction, you agree that you may not cancel nor reverse such transaction. BEC Pay shall proceed with crediting the account of the Recipient and once the money or fund is in the account of the Beneficiary or Recipient, BEC Pay cannot reverse nor deduct such account without the proper order from authority or Law.
- You agree not to use the Services for any purpose that is illegal, unlawful or prohibited by these Terms, or to solicit the performance of any illegal activity or other activity which infringes on the rights of BEC Pay or others, which includes but is not limited to 1) selling, leasing or giving your Account to a third party, 2) earning monies, goods or services by performing transactions using the Services for a third party, and 3) acting as a remittance agent using the Services. You further agree not to modify, rent, lease, loan, sell, distribute, or create derivative works based on any content, material or information, either in whole or in part, available on or through the Services, unless you have been specifically permitted to do so by BEC Pay or by the owner of that content, material or information in a separate agreement.
- You agree that you are responsible to check for update/s and will download such update/s to the BEC Pay App before use. You understand that certain BEC Pay App functions may not be available or disabled by BEC Pay if you do not perform the needed update.
- You shall not share any passwords, Personal Identification Numbers (PIN codes, password, OTP), IDs related to payment authorization or login details. The User acknowledges that any such disclosure shall be the absolute liability of the User who shall be liable for any losses sustained as a result of such disclosure or by any act of negligence.
- All transactions initiated by the User from any Payment Instrument registered in the App is the sole liability of the User. You agree and acknowledge that the use of the App is personal to the User and at his/her full risk and liability. The User may not assign it to anyone else.
- You will be solely responsible and BECP shall not be liable to the User for any loss or damage whatsoever and of any kind as a result of fraudulent activity, unauthorized use or misuse of the App.
- BECP shall ensure its best effort to secure the App and all information related to it including card holder and User data in accordance with applicable laws, international standards including VAPT and best practices.
- For transfers/payments to accounts, the User authorizes BECP to debit his/her account based on a request initiated by the User through the App for the purpose of payment or transfer.
15. Termination
- The User may terminate this agreement at any time by contacting the Call Centre.
- The User shall remain responsible for any and all transactions made through the App until such termination.
- BECP can terminate, change these Terms, or add or delete any items in these Terms at any time.
- BECP will provide notice if required by Law. The User cannot change these Terms but can terminate these Terms at any time.
- User accepts and understands that it is his / her responsibility to refer to the updated Terms and will have no right to make any claim against BECP due to lack of his / her notification or consent to the changes made to the Terms, to the extent permitted by applicable laws.
16. Warranties
- We do not warrant and shall not be responsible due to failure of operational systems or technical issues or any reason beyond its reasonable control.
- The User shall remain responsible for any and all transactions made through the App.
- We cannot give any undertaking that products or services purchased using the App will be of satisfactory quality, and any such warranties are DISCLAIMED absolutely.
17. Privacy
- We use Your personal data in the manner set out in Our Privacy Policy which can be referred through our website and App.
- Using the Service and the App, you consent to the collection and use of Your personal data in the manner set out in the Privacy Policy.
- If We decide to change Our Privacy Policy, we will post those changes on the Privacy Policy page so that You are always aware of what information We collect, how We use it and under what circumstances We disclose it. You should check the Privacy Policy frequently for changes. We will protect Your personal data and maintain its confidentiality including where it is held by an agent or third party on behalf of Us and ensure that We have in place and maintain adequate policies, procedures, and controls.
- We will not disclose Your Personal Data unless: (i) required to do so by applicable laws and regulations, by CBK or other competent authority in the State of Kuwait; or (ii) the disclosure is made with Your prior written consent. 18. Proprietary Rights
- The User acknowledges that the underlying software required for accessing the App availing the service(s) are the legal property of BECP.
- The permission given by BECP to access the App avail the Service(s) will not convey any proprietary or ownership rights in such software.
- The User shall not attempt to modify, translate, disassemble, decompile, or reverse engineer the underlying software or create any derivative product based on the software.
19. Governing Law
These Terms and Conditions and any amendments thereto from time to time shall be governed by and construed in accordance with the laws of the State of Kuwait and subject exclusively to the jurisdiction of the Kuwait Courts.
